External legal systems do not define its meaning
External Legal Systems Do Not Define Its Meaning Category: Tsm’syen Law Page status: Working
Principle
External legal systems do not define its meaning.
Meaning
The interpretation of ayaawx and the understanding recorded in the Codex arise from internal sources of authority, relationship, and recognition. Meaning is not created or controlled by outside courts, governments, or legal traditions.
Function
This principle protects the integrity of interpretation. It ensures that understanding remains grounded in those who carry the law, remember precedent, and hold responsibility within the Nation.
Requirements
Use of the Codex must look first to internal knowledge, witnesses, elders, houses, and lawful process. External viewpoints may be heard but cannot replace internal authority.
Limits
This principle does not prevent dialogue or explanation across systems. It prevents substitution of outside definitions for those that arise from ayaawx.
Implications
Authority over meaning remains with the people and relationships from which the law comes. Reliance on external definitions risks distortion and loss of continuity.
