Purpose

This entry defines what makes an authority competent under Tsm’syen law. Competence is not assumed by position, title, or external recognition. It is determined by knowledge of law, lawful authority, and relationship to the matter at hand.

Competence is determined by knowledge, authority, and relationship.

Knowledge

Competence requires knowledge of the law being applied.

Knowledge includes:

  • Understanding of ayaawx governing the matter
  • Familiarity with relevant adaawk and precedent
  • Awareness of consequences across relationships and generations

Authority exercised without knowledge cannot produce lawful outcomes.

Authority

Authority must be lawfully grounded.

Lawful authority arises from:

  • Responsibility recognized within Tsm’syen law
  • Proper placement within house, clan, or collective structures
  • Conduct consistent with ayaawx

Title alone does not establish competence.

Relationship

Competence depends on relationship to the matter.

Relationship includes:

  • Connection to the people involved
  • Connection to the land or territory affected
  • Standing established through conduct and recognition
  • Proximity to the lived consequences of the decision

Distance from the matter limits competence.

Interdependence of the Three

Knowledge, authority, and relationship are inseparable.

  • Knowledge without authority lacks standing
  • Authority without knowledge lacks legitimacy
  • Relationship without responsibility lacks capacity

All three must be present for competence to exist.

What Does Not Establish Competence

Competence is not established by:

  • Convenience or efficiency
  • External appointment or assumption
  • Institutional power alone
  • Familiarity with non-Tsm’syen legal systems

These factors may coexist with competence, but they do not create it.
